Terms and conditions of use

1. GENERAL INFORMATION

The website www.marathon.com.co (hereinafter, the “Site”) is an institutional portal managed and owned by Grupo SAKA S.A.S., a company legally incorporated in Colombia, domiciled in Bogotá and identified with tax ID (NIT) 830.106.416-8.

The Site is the digital presence of Marathon, a registered brand exclusively owned by Grupo SAKA S.A.S., dedicated to the specialized manufacturing of socks and textile products for third parties under B2B and private-label models.

Accessing, browsing and using the Site implies full and unreserved acceptance of these Terms and Conditions.

2. INTELLECTUAL PROPERTY

All content on the Site, including but not limited to texts, designs, layouts, logos, trademarks, trade names, photographs, graphics, downloadable files, source code and other associated elements, is the exclusive property of Grupo SAKA S.A.S. or its licensors and is protected by Colombian and international intellectual property laws.

Its reproduction, modification, distribution, transmission, publication, adaptation or any other unauthorized use is prohibited without the prior express written authorization of Grupo SAKA S.A.S.

3. PERMITTED USE OF THE SITE

The purpose of the Site is to provide institutional information about the company, its production capabilities, corporate principles and general portfolio. It is not intended for the direct sale of products or for electronic commercial transactions.

Users agree to use the Site's content lawfully, ethically and in accordance with the purposes set out herein, refraining from any misuse or use that infringes the rights of third parties.

4. CONTENT SHARED BY THE USER

If users send comments, suggestions or information through contact forms or any other channel enabled on the Site, they shall be deemed to grant Grupo SAKA S.A.S. a free, non-exclusive, worldwide license for its institutional use, without implying any obligation of compensation. This license does not cover the user's personal data, which is handled confidentially in accordance with the Privacy and Personal Data Processing Policy of Grupo SAKA S.A.S.

5. LIMITATION OF LIABILITY

Grupo SAKA S.A.S. does not guarantee the continuous availability or error-free operation of the Site. Consequently, it shall not be liable for interruptions, damages, loss of information, computer viruses, system failures or any event affecting access to the Site or the integrity of its content.

The information published is for informational purposes only. It does not constitute a commercial offer, a contractual proposal or technical, legal or commercial advice.

6. PERSONAL DATA PROTECTION

Grupo SAKA S.A.S. may collect personal data through the Site exclusively for institutional purposes and in strict compliance with Law 1581 of 2012 and its implementing regulations.

The data provided will be processed in accordance with the Personal Data Processing Policy of Grupo SAKA S.A.S., available on this Site, and users may at any time exercise their rights of access, update, rectification or deletion by writing to: privacidad@marathon.com.co.

7. USE OF COOKIES

The Site does not use its own cookies or any analytics or advertising tools. Some third-party services embedded in the Site, such as Google Maps and Google Fonts, may set cookies or log technical browsing data under their own policies, as described in the cookies section of our Privacy policy.

Users may set their browser to block or delete cookies. However, this may affect how those services work.

8. EXTERNAL LINKS

The Site may contain links to third-party websites for informational purposes. Grupo SAKA S.A.S. does not control, endorse or assume any responsibility for the content, policies or privacy practices of such external sites.

9. CHANGES

Grupo SAKA S.A.S. reserves the right to modify, update or remove these Terms and Conditions, as well as any content on the Site, at any time and without prior notice. New versions will take effect upon publication.

Users are advised to review this document periodically.

10. GOVERNING LAW AND JURISDICTION

These Terms and Conditions are governed by the laws of the Republic of Colombia. Any dispute related to the interpretation, application or enforcement of this document shall be resolved before the competent courts of the city of Bogotá D.C.
